01What's this?
These are the terms of service ("Terms") for using xagilab.com, the ATLAS application at tryatlasagi.com, and any related apps, APIs, or services we offer (together, the "Service"). When you use the Service, you agree to these Terms.
"We" / "us" / "XAGI" means XAGI Labs Private Limited, incorporated in India. "You" means the person using the Service.
02Your account
To use most of the Service you'll need an account. You agree to:
- Give us accurate information when you sign up.
- Keep your credentials private. You're responsible for what happens on your account.
- Be at least 16 years old, or have your guardian's consent if you're between 13 and 16.
- Not share, sell, or transfer your account to anyone else.
We may suspend or close accounts that violate these Terms, ours or others' rights, or applicable law. Where possible we'll warn you first and explain why.
03What you can do with ATLAS
ATLAS is an autonomous agent. You can ask it to do things on your behalf — within your computer, within services you've connected, within the limits you set. We've built strong defaults, but the system is powerful, so:
- You stay accountable for actions ATLAS takes on your behalf. You've authorised it. Treat it like an assistant whose work is signed in your name.
- Use ATLAS legally where you are. We don't know your local laws better than you do.
- Review the audit log periodically, especially in the early weeks. The "human-in-the-loop" prompts exist for a reason — please use them.
04What you can't do
You agree not to use the Service to:
- Break the law, infringe someone's rights, or cause real-world harm.
- Generate or distribute material that sexually exploits minors, incites violence, or facilitates terrorism.
- Stalk, harass, dox, or impersonate anyone.
- Build weapons, malware, or anything similarly destructive.
- Reverse-engineer, decompile, or attempt to extract our model weights or training data.
- Probe or attack the Service's infrastructure (security research is welcome through security@xagilab.com — please don't do it without telling us first).
- Resell or relabel the Service as if it were yours.
Bad-faith violations can lead to immediate account suspension and, where relevant, referral to authorities.
05Pricing & payment
The Service is in pre-release. Joining the waitlist is free. As we open paid plans, the prices and what they include will be shown clearly before you commit.
When charges apply:
- Prices are in the currency shown at checkout. Taxes (GST, VAT, etc.) are added where required.
- You can cancel any subscription at any time. You keep access until the end of the billing period.
- We'll process refunds where required by law or where we've clearly let you down. We're not great at robotic refund denials.
- Pre-release pricing is grandfathered for at least 12 months from your first paid month.
06Your content, your memory
You own what you put into ATLAS — your conversations, files, memory, prompts. We only need a narrow licence to operate the Service: to store, transmit, process, and display your content so ATLAS can do what you asked. This licence ends when you delete the content or close your account (subject to short technical retention windows; see the Privacy page).
We do not train shared models on your data. Period.
07Our content & intellectual property
The Service, the ATLAS software, our trademarks, our research notes, and the design of this website are owned by XAGI Labs. You're welcome to read, share, and link to anything published here. You may not copy substantial portions, resell our content, or pass it off as your own.
If ATLAS produces something for you on your machine using your data and your tools — a document, a piece of code, a design — that output is yours. We claim no rights to it.
08Third-party services
ATLAS integrates with model providers (Anthropic, OpenAI, Google), payment processors, and other third-party tools. Your use of those is also subject to their terms. We pick partners who respect users; we cannot fully control how they operate.
09Beta status & warranties
ATLAS is in private cohort as of May 2026. Some things will break. We work hard to make the Service reliable, but, to the extent allowed by law, the Service is provided "as is" and "as available", without warranties of any kind — express, implied, statutory, or otherwise — including merchantability, fitness for a particular purpose, and non-infringement.
If you depend on ATLAS for something mission-critical, build a fallback. We mean this in a friendly way: it's a real risk, not theoretical.
10Liability
To the maximum extent allowed by law, XAGI Labs' total liability to you for any claim arising out of or related to the Service is limited to the greater of (a) the fees you've paid us in the 12 months preceding the claim, or (b) ₹10,000 (approximately US$120).
We are not liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits, lost data, or loss of goodwill.
11Indemnity
If your use of the Service violates these Terms, the law, or someone else's rights, and someone sues us as a result, you agree to defend us and cover the reasonable cost of that defence. We'll tell you promptly and let you participate.
12Suspension, termination & data export
You can close your account from the desktop app or by emailing hello@xagilab.com. Before you do, you can export your memory and conversations from settings.
We may suspend or terminate your account for material breach of these Terms, for legal reasons, or if continuing the Service would be unsafe. Where possible we'll give you notice and a chance to fix things.
13Changes to the Terms
We'll change these Terms from time to time. For material changes we'll email everyone with an active account at least 14 days before they take effect. If you don't agree, you can close your account before the new Terms apply.
14Governing law & disputes
These Terms are governed by the laws of India. Any dispute that can't be resolved by talking it through goes to the courts of Bengaluru, Karnataka — unless your local consumer protection law gives you a stronger forum, in which case that one applies.
Before filing anything, please email legal@xagilab.com. We genuinely prefer a conversation to a courtroom.
15Miscellany
- If any part of these Terms is found unenforceable, the rest stays in force.
- If we don't enforce a right, that doesn't mean we've given it up.
- You can't assign these Terms to anyone else without our consent. We can assign them to a corporate successor (e.g. in a merger).
- These Terms, plus the Privacy page, form the entire agreement between you and us about the Service.
